As A Level candidates are now studying both criminal and civil substantive law in the same course, there was some evidence that for some candidates the two are merging together.
Examples include citing criminal causation cases like Pagett, Smith & Cheshire when dealing with causation in negligence and using the language and culture of criminal law through inappropriate reference to guilt not liability, sentencing, punishment and jury decisions
It is important that students keep the two areas of law separate.
